Enerlex ("we," "our," or "us") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy ("Policy") applies to enerlex.com, and Enerlex, Inc. and governs data collection and usage. Our website is an informational site. By using our website, you consent to the data practices described in this statement.

1. California Consumer Privacy Act and California Privacy Rights Act 

If you are a California resident, you have the following rights under the California Consumer Privacy Act ("CCPA") and California Privacy Rights Act ("CPRA"):

  • Right to Delete. You can request deletion of personal data, subject to certain legal exceptions. 

  • Right to Correct. You may request corrections to inaccurate personal information. 

  • Right to Opt-Out. You can opt out of the sale or sharing of personal data for advertising. 

  • Right to Restrict Sensitive Data Use. We do not collect, use, or disclose 'Sensitive Personal Information' as defined by the CCPA.

  • Right Against Retaliation. We will not discriminate against you for exercising your rights.

In order to better provide you with products and services offered, we may collect personally identifiable information, such as your:

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our services. Additionally, we may collect information from third-party sources, including publicly available government records, property filings, and mineral interest databases, to facilitate our business operations. You may be required to provide certain personal information to us when you elect to use certain services. Please do not submit sensitive personal information (e.g., Social Security numbers, financial data, or health information) when filling out our contact form.

We do not sell, rent, or lease its customer lists to third parties.   

We may share data with third-party service providers to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. We may automatically collect certain technical information about your visit through our website platform provider (Framer), including your IP address, browser type, device characteristics, access times, and referring website addresses. This data is used strictly for operational and analytical purposes and does not identify you personally. Our website uses Framer's privacy-friendly analytics which do not use cookies or track personal data. However, if you interact with integrated third-party content (like maps or videos), those providers may use their own cookies.

6. Security of your Personal Information 

We secure your personal information from unauthorized access, use, or disclosure. When personal information is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.

We strive to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet that are beyond our control; and (b) the security, integrity, and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed.

We retain the personal information we collect for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the data and the potential risk of harm from unauthorized use.

8. Right to Deletion 

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:   

 - Delete your personal information from our records; and 

 - Direct any service providers to delete your personal information from their records.  

Under the CCPA and CPRA, you have the right to request that we, and any third parties with whom your personal information is sold or shared, delete any personal information that has been collected about you. Please note that we cannot fulfill deletion requests for information that is part of a public government record or property filing that we index for research purposes.

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to: 

 - Complete the transaction for which the personal information was collected, and provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us; 

 - Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity; 

 - Debug to identify and repair errors that impair existing intended functionality; 

 - Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law; 

 - Comply with the California Electronic Communications Privacy Act;  

 - Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;

 - Comply with an existing legal obligation; or 

 - Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information. 

9. Children Under Thirteen

This website is not for use by children under the age of 13 years and we do not knowingly collect, store, share, or use Personal Information of children under 13 years. If you are under the age of 13 years, please do not provide any Personal Information, even if prompted by the website to do so. If you are under the age of 13 years and you have provided Personal Information, please ask your parent(s) or guardian(s) to notify us and we will delete all such Personal Information.

10. Email Communications 

From time to time, we may contact you via email for the purpose of providing offers and/or other general communication. 

If you would like to stop receiving communications via email from us, you may opt out of such communications by contacting us at privacy@enerlex.com. 

11. External Data Storage Sites 

We may store your data on servers provided by third-party hosting vendors with whom we have contracted. 

12. Changes to This Statement 

We reserve the right to change this Policy from time to time. For example, when there are changes in our services, changes in our data protection practices, or changes in the law. When changes to this Policy are significant, we will inform you by placing a prominent notice on our website, and/or by updating any privacy information. Your continued use of the website and/or services available after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by that Policy.
